‘Wrong to execute judgments issued by foreign countries’

The Ministry of Justice has forwarded two draft bills to the Cabinet — one on the amendment of legislation related to combating corruption and ensuring transparency and another on the completion of the e-government project, reports Al-Qabas daily quoting sources.

Sources clarified Deputy Premier for Legal Affairs, Minister of Justice, Awqaf and Islamic Affairs Rashid Al-Hammad presented the draft bills. Sources stated the minister is keen on amending the legislation in line with the international requirements and development plan of the government.

Sources revealed the estimated cost for the implementation of the first proposal is KD 400,000, while the budget for the second bill has yet to be specified as the ministry is still waiting for a report on the manpower required for the execution of both proposals.

Sources also unveiled a plan to form committees later to follow up the implementation of the proposals, especially the amendment of the abovementioned laws, in addition to monitoring a number of studies and statistical research. Sources added an integrated mechanism will be laid down soon to ease procedures for the completion of transactions in courts.

It is wrong to execute judgments issued by foreign countries before the case is tried by the country’s judicial system, Al-Rai daily quoted legal expert Dr Mohammad Al-Faili as saying.

He was referring to the case of Sheikh Talal Al-Fahad. Another expert Dr Obaid Al-Wasmi affirmed that Al-Fahad violated the country’s judicial system and he should not be reinstated to his leadership position in the Kuwait Football Federation, based on FIFA or any international court ruling, unless Kuwaiti judiciary issues a verdict to this effect.

He explained that the local court would have based its ruling on the decision of the Public Authority for Youth and Sports (PAYS) after considering relevant criteria. He noted that executing foreign rulings is optional and “local procedures should always precede the execution of such rulings.”
