The Director General, National Information Technology Development Agency (NITDA) Cleopas Ngayan, has said that a good regulatory framework is important for a practicable electronic transaction in the country.

Mr. Ngayan said this when the Inter-Agency Drafting Committee members presented the e-Transaction Draft Bill to him on Monday in Abuja. He noted that e-Transaction had been flawed by lots of errors that cannot be brought to book, because they was no regulatory law guiding it.

"The E-Transaction in the country is yet to have a regulatory frame work and is not tenable in law and so cannot be admissible, having a bill on it will make it possible to prosecute people who become fraudulent with electronic transactions.The draft bill which hopefully would become law in three months time would ensure Internet enabled outsourcing as is being done in Indian and China," he said.

"The Chairman of the Inter-Agency Drafting Committee, Inye Kemabonta, noted that "the absence of a legal framework in the electronic environment has several implications on the socio-economic growth of the country.

"The draft, when passed into law, would make electronic transactions and communication valid and admissible in court. Without such a framework, the actualisation of the reform programme and Vision 20:2020 would remain a mirage because the Vision 20:2020 project is dependent on such framework for electronic communication," says Mr Kemabonta.

There have been reported cases of financial crimes such as the Automated Teller Machine (ATM), linked to the banking sector on the mysterious disappearance of funds from customers' accounts.

Banks have lost billions of naira to e-frauds through ATMs, as banks and Interswitch struggle to find a solution to it, with none claiming responsibility. Mr.Ngayan said that the three months period was to allow input from various stakeholders across the country, before the draft was finally passed to the House.

"The bill is fundamental to improving e-transaction in the country as well as guarantee an inflow of online businesses in the economy. It will also ensure that banks have their machines placed in good order before they embark on ATM services, lest they be penalised," he said.

Mr. Kemabonta gave the assurance that the framework of the bill will make the international community see the country as being investment friendly.

"It will help the electronic commerce and the Federal Government's e-Government programme and also provide a form of security for online information using the online environment."
