On March 1, 2024, Hong Kong took a significant leap towards becoming a smart city with the gazette publication of the Telecommunications (Amendment) Ordinance 2024. This landmark ordinance paves the way for mobile network operators to install and maintain mobile communications facilities (MCFs) in new buildings, streamlining the deployment of 5G infrastructure across the city. The Legislative Council passed this amendment on February 21, marking a pivotal moment in Hong Kong's journey towards enhanced 5G mobile services and smart city development.

Streamlining 5G Infrastructure Deployment

The Amendment Ordinance is a response to the initiative proposed in the 2022 Policy Address, aimed at institutionalizing the arrangement for installing MCFs in specified buildings. By providing a legal basis for the Communications Authority (CA) to grant authorized access to mobile network operators, the ordinance facilitates the installation and maintenance of 5G infrastructure. This move is expected to expand Hong Kong's 5G network coverage significantly, thereby supporting the city's smart city aspirations. To aid in the implementation, the CA will issue a detailed code of practice, complemented by revised administrative guidelines from relevant government departments.

Adapting Legislation to Smart City Needs

Alongside facilitating 5G deployment, the Amendment Ordinance also updates the Telecommunications Ordinance and its regulations to align with Hong Kong's Basic Law and its status as a Special Administrative Region of China.
